Terms of Service

The terms on which we sell Juncao fodder cuttings, hay and related services, and on which you use this website.

Please read first

This document follows the structure of the Digital Moran Terms of Service, adapted to what Moran Farms actually sells. It has not yet been reviewed by a qualified Kenyan advocate. Have it checked before you rely on it commercially, particularly the sections on payment, risk in transit and liability.

1. Introduction and Acceptance of Terms

Welcome to Moran Farms. These Terms of Service (“Terms”) govern your use of this website and any purchase of goods or services from us. Moran Farms is a farming enterprise at Illasit, near Oloitokitok, Kajiado South, Kenya, operated as a social enterprise of Digital Moran CBO.

By placing an order with us, whether by phone, WhatsApp, email or in person, you agree to be bound by these Terms. If you do not agree with them, please do not place an order.

2. Definitions

  • Goods: Juncao planting cuttings, fodder, hay, farm produce and any other physical items we supply.
  • Services: silage preparation support, agronomy advice, farm training and any other service we agree to provide.
  • Buyer: any person or organisation that orders Goods or Services from us.
  • Order: a request for Goods or Services that we have confirmed, whether in writing or verbally.
  • Cuttings: sections of mature Juncao cane, each carrying at least one bud, supplied as planting material. Also referred to as nodes.

3. General Buyer Responsibilities

  • Eligibility: you must be at least 18 years old to place an Order.
  • Accurate information: you are responsible for the delivery details you give us. We are not liable for a consignment sent to an address or collection point you supplied incorrectly.
  • Good faith: you agree to deal with us honestly and to raise any problem with an Order promptly rather than after the planting window has passed.

4. Specific Provisions: Sale of Goods

4.1. Orders and Quotations

  • Published prices are KES 20 per cutting, with a minimum order of 100 cuttings, and KES 17 per cutting from 1,000 cuttings and above. Delivery is quoted separately according to destination.
  • A quotation is valid for fourteen (14) days unless we state otherwise. Prices may change with season and demand, and the price confirmed on your Order is the price that applies to it.
  • An Order is binding once we have confirmed it and, where a deposit applies, once that deposit has been received.
  • Because planting material is cut fresh for each consignment, we may decline or reschedule an Order where weather, crop condition or stand maturity means we cannot supply material of an acceptable standard. Where we do, any deposit paid for that Order is refunded in full.

4.2. Payment

  • Prices are quoted in Kenya Shillings (KES) and, unless stated otherwise, include packing.
  • For larger Orders we normally require a deposit before harvesting begins, with the balance payable on dispatch. The exact arrangement is confirmed with you before any crop is cut.
  • We do not hold Buyer funds beyond the value of a confirmed Order, and no interest accrues on amounts paid to us.

4.3. Delivery and Risk

  • We deliver countrywide using couriers and parcel services. Cuttings are harvested on the morning of dispatch and packed to remain viable in transit.
  • Delivery dates are estimates given in good faith. We are not liable for delays caused by carriers, weather, road conditions or other matters outside our control.
  • Risk in the Goods passes to the Buyer on delivery to the Buyer or to the carrier nominated or accepted by the Buyer, whichever happens first. Where a carrier damages or loses a consignment, we will assist with the claim.
  • You must inspect Goods on arrival and notify us of any visible problem within twenty-four (24) hours of delivery.

4.4. Planting Material and Germination

Canes are selected at maturity, cut by hand, trimmed clean and packed to breathe. Every consignment leaves here in a condition we would plant ourselves.

  • We warrant that Cuttings are taken from healthy, mature stands and carry viable buds at the time of dispatch.
  • We cannot warrant germination or yield. Once material leaves our farm, results depend on how quickly it is planted, planting depth, soil condition, moisture, weed control, fertility, weather and management, all of which are outside our control.
  • Any agronomic figures we publish or give you, such as spacing, cutting intervals, crude protein and tonnage, are indicative ranges for well managed stands. They are guidance, not a guarantee of performance on your land.
  • If a consignment fails to sprout, contact us promptly. Where the material itself was at fault, we will replace it or refund it at our option. This is your sole remedy in respect of germination.

4.5. Cancellation and Returns

  • You may cancel an Order at no cost before we begin harvesting for it.
  • Once cutting has begun the Goods are perishable and cannot be restocked, so deposits at that stage are non-refundable except where we are at fault or unable to supply.
  • Nothing in this section limits your rights under the Consumer Protection Act, 2012 or any other applicable Kenyan law.

5. Specific Provisions: Services

5.1. Silage Support

  • We advise on and supervise silage preparation on your own farm, in your own pit. We do not sell silage in bags and we do not operate as a contracting service.
  • The scope, dates and price of any visit are agreed in advance. You remain responsible for your own site, equipment, crop condition and the safety of your own staff.
  • Advice on harvest timing, chop length, compaction, sealing and feeding rates is given in good faith based on our own experience. Final decisions about your livestock and your crop remain yours.

5.2. Farm Training

  • Our youth training sessions are offered free of charge. Places are limited and we may set reasonable conditions on attendance.
  • Participants attend at their own risk, must follow instructions on the farm, and must be supervised by a parent or guardian if under 18.

6. Use of This Website

  • The photographs on this site were taken on our own farm. The text, images, layout and branding are the property of Moran Farms and Digital Moran CBO. Please do not reproduce them commercially without written permission.
  • Information on this site is provided for general guidance and may change without notice. It is not agronomic, veterinary, financial or legal advice for your particular situation.
  • This site does not take payments and has no contact form. All ordering happens by phone, WhatsApp or email.

7. Limitation of Liability

To the maximum extent permitted by Kenyan law, our total liability arising out of or in connection with any Order is limited to the amount you paid for that Order. We are not liable for indirect or consequential loss, including loss of profit, loss of milk production, loss of livestock, or loss arising from crop failure.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

8. Disputes

If something goes wrong, call us first. Most problems are solved in one conversation. If that does not resolve it, we will attempt in good faith to settle the matter by discussion, and if necessary by mediation, before either party goes to court.

9. Governing Law

These Terms of Service and any dispute arising from them shall be governed by and construed in accordance with the laws of the Republic of Kenya, and the courts of Kenya have jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. The version published on this page at the time you place an Order is the version that applies to that Order.
